does any one know if jailbroken ps3 is able to forgo the firmware check? if not if i back it up will i have to get rid of the firmware file or replace it with that of another game?

It doesn't skip the check, you'll have to google to see if there is a workaround for the particular game you want to play, which game is it?

i dont get the question u want to update your game? or worried about firware upgrade?

I think he is trying to play a game that requires a firmware higher than his. Like MOH (which can be circumvented)

yes exactly... MOH and assassins creed 3. they both have fw requirements that are higher then 3.41

first assasins creed 3 is not out second u can play MOH by updating it after doing some other things what game u wanting to play

atm assassins creed 3... i have an early copy of it. work at a local game store.
